Our Principles

We have a simple approach to data protection and privacy which adheres to the 13 Australian Privacy Principles.

Our obligations under the Privacy Act 1988 (Privacy Act):

What we collect from you

Mailing list

If you sign up to one of our mailing lists, this means that you have opted-in and have consented to us sending you emails relating to what we do and provide as a company. Don’t worry, we won’t spam you. We send all emails as per the guidelines set out by the Australian Communications and Media Authority. Contacting Support

If you contact us for any technical, product or other website related support, we may retain that information on record so as to process your request as well as for training purposes. Such information may include the transcript, emails or other information which was relayed by you and Enhance 3d throughout the support request process.

When you sign up with us and create a login with us

When you sign up to our website using your personal details, we will collect this personal information so that your user preferences are stored when you come back and login.

User contact forms

When you fill out a contact form wishing to get in touch with us, we will collect that information and use it to get in touch with you in response to your query. We may use the information to reach out to you to inform you of some of the services we provide, provided it is in line with your original query.

Quality of Personal Information

Data Security

We take active steps to protect the personal information we hold against loss, unauthorised access, use, modification or disclosure, and against other misuse. These steps include password protection for all of our IT systems. Please read these terms carefully. They govern your use of the Aussie4x4 demo game for PC and OSX and your access to products from this website. They exempt Enhance3D (E3D) and other persons from liability or limit their liability, and contain other important provisions.

They govern your access to and use of Aussie4x4 ‘ aussie4x4game.com website (the “Website”) and demo games (the “Demo Games). These Terms also may refer to and benefit E3Ds‘ affiliates, service providers, suppliers and other persons.

 

Each time you use our Website or play the Demo Games you have agreed to be bound by these Terms as they then read. You represent and warrant that you have the legal authority to agree to and accept these Terms on behalf of yourself and any person or entity you claim to represent. If you do not agree with these Terms, you may not access or use the Website, Demo Games or any related products or downloads. You may use the Website or Demo Games only as expressly permitted in these Terms and subject to all applicable laws. You may not sell or resell any part of the Website or Demo Games or access to the Website or Demo Games. You may not use any of the software that is used in the operation or provision of the Website or Demo Games except while you are using the Website and Demo Games in accordance with these Terms.

 

4. Registered users; protecting login information

Certain areas and features of our Website are available only to registered users. If you register as a user, you will be issued a login name and password by E3D. Although E3D has no obligation to verify the actual identity or authority of any person registering to use the Website, E3D may in its discretion require proof of the identity of any person seeking to access and use the Website and Demo Games, and may deny access to and use of the Website and Demo Games or refuse to accept or act upon any communication from a user.

If you have registered a login name and password, you should not disclose your login name or password to any other person or let any other person use your login information.

 

5. Use and ownership of user provided content

If you provide EB Games with any unsolicited ideas, suggestions, audio samples, imagergy, 3d models or post any content on the Website, you (i) represent and warrant that you are the owner or creator of such content (or have received permission from the owner or creator to make such submissions or postings subject to the Terms), and (ii) grant to E3D, its successors, assigns and licensees, a worldwide, perpetual, royalty-free, irrevocable, unrestricted, nonexclusive, assignable, sub licensable, right and license to use and exploit such submissions or content for any purpose whatsoever, commercial or otherwise, using any form, media or technology now known or later developed, without providing any attribution or compensation to you or any other person, without any liability whatsoever, and free from any obligation of confidence or other duties on the part of E3D or its successors, assigns and licensees, and you agree, represent and warrant that all moral rights in such submissions and/or content are waived in favor of E3D and its successors, assigns and licensees.

 

6. Accuracy of information you provide to EB Games

All information you provide to E3D through this Website, including registration information and transaction-related information, must be true, accurate and complete. You will be solely responsible and liable for any and all loss, damage, and additional costs that you, E3D or any other person may incur as a result of you providing any false, incorrect or incomplete information.

 

7. Trademarks/logos

E3D, Aussie4x4, Ehance3D, the aussie4x4game.com logo and other names and logos that are used on our Website (the “Marks”) are registered or unregistered trademarks, service marks, trade names and logos owned or licensed by E3D or their respective owners or licensees. Any use of the Marks (other than as permitted by these Terms) is prohibited. Nothing in this Website shall grant, or is intended to grant, any license or right to use any of the Marks.

 

8. No linking, framing, mirroring, scraping, data-mining or unauthorized postings

Linking to the Website without the prior written permission of E3D is prohibited. If you desire to link to our Website, you may send an email to admin@aussie4x4game.com requesting such permission. E3D may in its discretion deny or revoke any permission it may give to link to the Website at any time and without any notice or liability.

The framing, mirroring, scraping or data-mining of the Website or Demo Games or any of its content in any form and by any means is prohibited. You may not use any collaborative browsing or display technologies in connection with your use of the Website or Demo games or to post comments or any other information of any kind to or on the Website that would be visible to any other users, except in connection with the use of Aussie4x4 forums or other Website locations intended for such comments and hosted by E3D.

 

9. Contests

E3D may make contests available to users of the Website and others. All contests are governed by these Terms and the applicable contest rules. By participating in a contest through the Website, you are agreeing to these Terms and the applicable contest rules.

You agree that your access to, and use of, this site is subject to these terms and all applicable laws, and is at your own risk. This site and its contents are provided to you on “as is” basis, the site may contain errors, faults and inaccuracies and may not be complete and current.

E3D makes no representations or warranties of any kind, express or implied as to the operation of this site or the information, content, materials or products included on this site, except as otherwise provided under applicable laws.

Neither E3D, nor its affiliates, directors, officers, employees, agents, contractors, successors or assigns will be liable for any damages whatsoever arising out of, or in any way related to, the use of this site and any other site linked to this site. This limitation applies to direct, indirect, consequential, special, punitive or other damages you or others may suffer, as well as damages for loss of profits, business interruption or the loss of data or information.

10.1 Viruses

E3D cannot guarantee that any file or program available for download and/or execution from or via this site is free from viruses or other conditions which could damage or interfere with data, hardware or software with which it might be used. You assume all risk of use of all programs and files on this site, and you release E3D entirely of all responsibility for any consequences of its use.

10.2 Spam

We will never knowingly send you electronic messages without your consent.

10.3 Use of Cookies

Cookies are small pieces of information that your browser stores on your computer hard drive.

We use cookies to provide you site usage information as well as to assist us to improve and develop the products and services we offer. Our cookies do not contain any personal identifiable information.

13. Governing law and dispute resolution

These Terms, your access to and use of the Website and Demo Games, and all related matters are governed solely by the laws of Queensland, Australia and applicable federal laws of Australia. Any dispute between you and E3D or any other person arising from, connected with or relating to the Website and Demo Games, these Terms, or any related matters (collectively “Disputes”) will be resolved before the Courts of Queensland, sitting in Brisbane, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of those courts in respect of all Disputes.

 

14. Other matters

All prices are in Australian Dollars.

If any provision of these Terms is held to be invalid or unenforceable for any reason, then the provision will be deemed to be severed from these Terms and the remaining provisions will continue in full force and effect.

Any rights not expressly granted by these Terms are reserved to E3D.
